TO THE FULLEST EXTENT PERMITTED BY LAW, ANW LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF VIRTUAL CURRENCY, LOSS OF DATA, OR INTERRUPTION OF SERVICE.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO ANW LLC IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless ANW LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of our Services, your violation of these Terms, or your violation of any third-party rights.
These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of our Services shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website with a revised effective date. Your continued use of our Services after any changes constitutes your acceptance of the revised Terms.
We may suspend or terminate your access to our Services at any time for any reason, including violation of these Terms, with or without notice. Upon termination, your right to use our Services will immediately cease. Sections 7 through 13 of these Terms survive termination.
